Welcome to AI Thumbnail Studio ("we," "our," or "us"). By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Use of the Service

Our platform provides AI-powered tools to generate thumbnails, typography, and SEO metadata. You agree to use the service only for lawful purposes and in accordance with these Terms.

• You must be at least 18 years old or have parental consent to use the service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree not to submit prompts that violate intellectual property rights, promote hate speech, violence, or illegal activities. We reserve the right to suspend accounts that violate these rules.

2. Credits, Subscriptions, and Payments

We operate on a credit-based and subscription model. All financial transactions are securely processed by Stripe.

• Credits: One credit is deducted from your account each time you generate an image/SEO package.
• Pay-As-You-Go: Purchased "lifetime" credit packs do not expire as long as your account remains active.
• Subscriptions: Monthly subscriptions renew automatically unless canceled before the next billing cycle. Unused monthly credits do not roll over to the next month unless explicitly stated.
• Refund Policy: Due to the digital nature of the service and the immediate cost we incur from AI APIs, all sales are final and non-refundable once credits have been used.

3. Intellectual Property and Commercial Rights

We do not claim copyright over the content you create. You are free to use the generated thumbnails and captions for YouTube, Instagram, client work, or other commercial purposes.

4. Service Availability and API Reliance

Our service relies on third-party APIs (such as OpenAI's DALL-E and ChatGPT). While we strive for 99.9% uptime, we cannot guarantee uninterrupted access.

• We are not responsible for delays, errors, or outages caused by third-party API failures.
• If a generation attempt fails due to a server error, your credit will not be deducted, or it will be refunded to your account automatically.

5. Limitation of Liability

In no event shall AI Thumbnail Studio, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, including but not limited to loss of revenue or data.

6. Termination

We reserve the right to terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
